During the inspection, it was established that the applicant's sister, Koroleva Olga Anatolyevna, periodically spent time in her country house located at the address: Tula region, Novomoskovsk, "Avtoremontnik" together with her roommate, Fotteler Evgeny Vyacheslavovich 08.05.1975.
05.06.2022 Koroleva O.A. and Fotteler E.V. were at the above address, where they drank alcohol during the day. At 21:30, Koroleva O.A. tried to call a taxi "2000" from her phone number in Novomoskovsk. In view of the fact that Koroleva O.A. was intoxicated, in a conversation with the taxi operator, Zabrodskaya E.A. could not clearly name the address of the house, so the taxi was not sent to order.
06.06.2022 at 00 hours 20 minutes to the address: Novomoskovsk, Demyan Bedny str., 49, located near the house where Koroleva O.A. and Fotteler E.V. were located, an ambulance was called, after which Koroleva O.A. was hospitalized at the state healthcare institution Novomoskovsk City Clinical Hospital. On 11.06.2022, without regaining consciousness, Koroleva O.A. died from an open craniocerebral injury.
From the explanation of Fotteler E.V., it follows that at the moment when Koroleva O.A. was descending from the second floor, she was in a state of alcoholic intoxication, as a result of which, unable to keep her balance, she fell, hitting her head on the stairs.
According to this fact, the investigative department for the city of Novomoskovsk of the investigative department of the Investigative Committee of Russia for the Tula region conducted an inspection, in which the following were interviewed: Fotteler E.V., Zabrodskaya E.A., ambulance crew workers, as well as Korolev I.A.
On 13.07.2022, based on the results of an inspection by the investigative department for Novomoskovsk of the Investigative department of the Investigative Committee of Russia for the Tula region, a decision was issued to refuse to initiate a criminal case on the grounds provided for in paragraph 1 of Part 1 of Article 24 of the Criminal Procedure Code of the Russian Federation, due to the absence of a crime event.
Proceeding from the above, it follows that there are sufficient grounds in the material of the pre-investigation check indicating the absence of any crime event provided for by the special part of the Criminal Code of the Russian Federation and, guided by paragraph 1 of Part one of Article 24 of the Code of Criminal Procedure, Articles 144.145 and 148 of the Code of Criminal Procedure of the Russian Federation
Decided:
1. Refuse to initiate a criminal case on the grounds of paragraph 1 of Part one of Article 24 of the Code of Criminal Procedure of the Russian Federation, due to the absence of an event of any crime provided for by the special part of the Criminal Code of the Russian Federation committed against Koroleva O.A.
