During the consideration of the appeal, it was established, that as part of the inspection carried out upon the death of Koroleva O.A., employees of the state healthcare institution of the Tula region "Territorial center for disaster medicine, ambulance and emergency medical care" were identified, from whom detailed explanations were received on the circumstances of the departure to Koroleva O.A., including the reasons for not transferring messages on the fact of departure to Koroleva O.A. to the department of the Ministry of Internal Affairs of Russia in Novomoskovsk.
According to the disposition of Part 2 of Article 316 of the Criminal Code of the Russian Federation, the responsibility of a person comes in case of the commission of a particularly serious crime not promised in advance.
As part of the procedural check, reliable data were obtained, that the death of Koroleva O.A. was not of a criminal nature and, based on the results of the procedural check, a decision was made to refuse to initiate a criminal case on the grounds provided for in paragraph 1 of Part 1 of Article 24 of the Code of Criminal Procedure, due to the absence of a crime event provided for in Part 1 of Article 105, Part 4 of Article 111 of the Criminal Code of the Russian Federation.
In this connection, the actions of the employees of the state healthcare institution of the Tula region "Territorial center for disaster medicine, emergency and emergency medical care" did not commit a crime under Part 2 of Article 316 of the Criminal Code of the Russian Federation.
13.08.2022 you were familiarized with the materials of the check on the fact of death by the Koroleva O.A. and you were handed a copy of the resolution on refusal to initiate criminal proceedings, which lists the established circumstances of injury and death by the Koroleva O.A.
